OM Basketball Terms of Service
OM BASKETBALL - TERMS & CONDITIONS, WAIVER & PARTICIPANT AGREEMENT

This website (www.ombasketball.com) is owned and operated by OM Basketball (Orhan Memedovski). These Terms & Conditions apply to all participants, parents/guardians, and users of this website. By registering for, paying for, or participating in any OM Basketball session, program, camp, or event, you agree to the following Terms & Conditions.
1. Participation & Assumption of Risk
Basketball is a physical and contact sport and participation involves inherent risks, including the risk of physical injury.
By enrolling yourself or your child in OM Basketball activities, you acknowledge and accept all risks associated with participation in basketball training, drills, games, and related activities.
2. Medical Responsibility & Emergency Consent
Parents/guardians confirm that all relevant medical conditions, injuries, allergies, or special needs have been disclosed prior to participation.
Participants are deemed physically fit to take part in basketball activities unless otherwise disclosed.
In the event of illness or injury where a parent/guardian cannot be contacted, OM Basketball is authorised to seek emergency medical treatment if required.
3. Limitation of Liability & Release
To the fullest extent permitted by law, OM Basketball, its coaches, staff, and representatives are not liable for any injury, loss, damage, or expense arising from participation in OM Basketball activities, except where caused by proven negligence.
Parents/guardians agree not to make any claim or take legal action against OM Basketball for injuries or losses sustained during participation.
4. Insurance
OM Basketball holds current Public Liability Insurance in accordance with Australian sporting and coaching requirements.
5. Code of Conduct
Participants are expected to behave respectfully, responsibly, and safely at all times.
OM Basketball reserves the right to remove any participant whose behaviour is unsafe, disruptive, or inappropriate. No refunds will be provided in such circumstances.
6. Session Changes, Cancellations & Make-Ups
Sessions may be cancelled, postponed, or relocated due to weather conditions, venue availability, illness, or unforeseen circumstances.
Where possible, notice will be provided. Make-up sessions or credits may be offered at the discretion of OM Basketball.
7. Payments & Refund Policy
All sessions, programs, camps, and events must be paid in advance.
All payments are non-refundable.
Missed sessions due to illness, injury, holidays, or personal reasons are not refundable.
Late arrivals do not entitle participants to additional session time.
All prices are listed in AUD. OM Basketball reserves the right to adjust pricing at any time.
8. Coach & Player Selection
OM Basketball reserves the right to select, group, modify, or deny participants for any session, program, or event.
Group sizes, session structures, and coaching formats may be adjusted at the discretion of OM Basketball.
9. Media Consent
By registering, parents/guardians consent to OM Basketball using photographs and video footage of participants for promotional purposes, including social media and the OM Basketball website. If consent is not granted, written notice must be provided prior to sessions commencing.
10. Intellectual Property
All content, images, videos, branding, and materials on this website are the property of OM Basketball and may not be reproduced, distributed, or rebroadcast without written permission.
11. Child Safety
The owner of OM Basketball holds a valid Working with Vulnerable People and Blue Card clearance, including police checks, and is a registered and certified teacher in Queensland.
12. Changes to These Terms
OM Basketball reserves the right to update or modify these Terms & Conditions at any time. Continued participation following changes constitutes acceptance of the revised terms.
13. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia.
